By downloading, installing, or using Gratitude Daily (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Gratitude Daily is a personal journaling application that allows users to record gratitude entries, track moods, view statistics, and sync data across devices. The App is available for iOS, iPadOS, macOS, and watchOS.

4.1 Free Tier

The App offers a free tier with limited functionality, including a maximum of 14 journal entries. Free tier users have access to basic features as described in the App.

New subscribers may be eligible for a 7-day free trial. At the end of the trial period, your subscription will automatically begin unless cancelled at least 24 hours before the trial ends.

5. User Content

5.1 Ownership

You retain all rights to the content you create in the App, including journal entries, photos, and other materials ("User Content"). We do not claim ownership of your User Content.

5.2 Storage

Your User Content is stored locally on your device and, if iCloud sync is enabled, in your personal iCloud account. We do not access, store, or process your User Content on our servers.

5.3 Responsibility

You are solely responsible for your User Content and ensuring you have the right to use any content you add to the App, including photos.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Guarantee

We do not guarantee that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

9.3 Not Medical Advice

The App is designed for personal journaling and wellbeing tracking. It is not intended to provide medical, psychological, or therapeutic advice. If you are experiencing mental health issues, please consult a qualified healthcare professional.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Gratitude Daily and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorney's fees) arising from your use of the App or violation of these Terms.

While we design the App to safely store your data, we are not responsible for any loss of User Content. We strongly recommend:

You may stop using the App at any time by uninstalling it. We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. Any disputes arising from these Terms or the App shall be resolved in the courts of Australia.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gratitude Daily regarding the App and supersede all prior agreements and understandings.
